I sold a nintendo wii on ebay with controllers games etc. The listed condition was new but in the description it nowhere said boxed up, sealed etc. I honestly rushed through the listing and marked it as 'new' instead of 'like new'. It's been opened but the darn thing is new. He wants a full refund but I don't think it is warranted. Does he have any grounds?
You owe him a refund, assuming that he returns it back to you in the exact same condition that he received it.
You advertised this as a new unit, and it wasn't. He didn't get what he paid for.
